Terms and Conditions (T&C)

§1 Scope and Definitions

(1) The following Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (§ 13 German Civil Code – BGB).

§2 Conclusion of Contract and Storage of Contract Text

(1) The following rules regarding the conclusion of a contract apply to orders placed via our online shop:

(2) In the event of a contract being concluded, the contract is entered into with:

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part but is merely a non-binding invitation for consumers to place an order. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our online shop, the following rules apply:
The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order process consists of the following steps:

  • Selection of the desired products

  • Confirmation by clicking the “Add to cart” button

  • Review of the information in the shopping cart

  • Clicking the “Checkout” button

  • Login after registration and entering login details (email address and password)

  • Review and correction of entered data

  • Binding submission of the order by clicking the button “Place order with obligation to pay” / “Buy”

Before submitting the binding order, the consumer may correct input errors or cancel the ordering process. We confirm receipt of the order immediately by an automatically generated email (“order confirmation”). With this email, we accept your offer.

(5) Storage of contract text: We send you the order data and our Terms and Conditions by email. For security reasons, your order data is no longer accessible via the Internet.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The stated prices include statutory VAT and other price components. Shipping costs may apply.

(2) The consumer may pay via:

  • Advance payment (bank transfer)

  • Cash on delivery

  • Direct debit

  • PayPal

  • Credit card (Visa, Mastercard)

(3) If advance payment is selected, the consumer undertakes to pay the purchase price immediately after conclusion of the contract.
If payment is made via cash on delivery, the purchase price becomes due upon receipt of the goods.

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items are ready for dispatch immediately. Delivery takes place within a maximum of 5 working days.

The period begins:

  • For advance payment: the day after the payment order is issued to the bank

  • For other payment methods: the day after the contract is concluded

If the deadline falls on a Saturday, Sunday, or public holiday, it ends on the next working day.

(2) The risk of accidental loss or deterioration of the goods transfers to the buyer only upon delivery.

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price has been made.

§6 Right of Withdrawal (Consumers)

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you takes possession of the goods.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, without undue delay and no later than fourteen days.

We may refuse reimbursement until we have received the goods back or you have provided proof that you have returned the goods.

You must return the goods no later than fourteen days.
You bear the direct costs of returning the goods.

End of withdrawal policy.

§10 Compatibility and Platform Changes Disclaimer

The product is designed to work with compatible consoles and software environments at the time of purchase.

We do not guarantee permanent compatibility with third-party hardware, software, operating systems, firmware updates, or platform changes.

In particular, we are not liable if functionality is limited, altered, or no longer possible due to updates, changes, restrictions, or technical measures implemented by console manufacturers (e.g. Nintendo) or other third parties.

Such changes do not constitute a defect of the product.

§11 No Affiliation Disclaimer

This product is an independent fan-made product and is not affiliated with, endorsed by, sponsored by, or approved by Nintendo.

Nintendo, Nintendo Switch, Pokémon, and all related trademarks are the property of their respective owners.

Any references to such trademarks are used solely for the purpose of describing compatibility and intended use.
