TERMS AND CONDITIONS (T&C)

§1 Scope and Definitions

(1) These Terms and Conditions apply to all orders placed via our online shop by consumers in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities (§ 13 German Civil Code – BGB).

§2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order.

(2) By completing the checkout process and clicking
“Place order with obligation to pay” / “Buy”
the customer submits a binding offer.

(3) The contract is concluded when we confirm the order via email.

(4) Order process:

  • Review cart
  • Proceed to checkout
  • Enter personal data
  • Review order
  • Submit binding order

(5) Order data and these T&C are sent via email. For security reasons, order data is not permanently accessible online.

§3 Prices and Payment

(1) All prices include statutory VAT where applicable.

(2) Shipping costs are displayed during checkout.

(3) Available payment methods:

  • Bank transfer (advance payment)
  • PayPal
  • Credit card (Visa, Mastercard)
  • Other payment providers displayed at checkout

(4) For advance payment, the amount is due immediately after contract conclusion.

§4 Delivery and Shipping Conditions

(1) We currently ship within the European Union only.

(2) Standard products:
Unless otherwise stated, dispatch takes place within 5 working days.

(3) Preorders / Pre-sale products:
If a product is marked as Preorder or Pre-sale, delivery may take up to 40 calendar days from the date of contract conclusion.

The estimated delivery time is stated on the respective product page.

(4) If payment is made via advance payment, the delivery period begins on the day after the payment order is issued to the bank.
For other payment methods, the period begins on the day after contract conclusion.

(5) If delivery delays occur due to circumstances beyond our control (e.g., supplier delays, customs, logistics disruptions), the delivery period may be extended accordingly.

(6) The risk of accidental loss or deterioration transfers to the buyer upon delivery.

§5 Retention of Title

The goods remain our property until full payment has been received.

§6 Right of Withdrawal (Consumers)

Withdrawal Policy

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., email):

You may use the model withdrawal form below, but it is not mandatory.

Consequences of Withdrawal

If you withdraw from this contract:

  • We shall reimburse all payments received from you, including standard delivery costs.
  • Reimbursement will be made within fourteen (14) days from the day we receive the returned goods or proof of return.
  • Refunds will be made using the same payment method used for the original transaction, unless expressly agreed otherwise.
  • We may withhold reimbursement until the goods have been received back.

You must return the goods within fourteen (14) days of informing us of the withdrawal.

You bear the direct cost of returning the goods.

The goods must be returned in original condition. Any diminished value resulting from handling beyond what is necessary to establish the nature and functioning of the goods may be deducted from the refund.

Exclusion of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made or personalized products
  • Digital products once download or access has started (if applicable)

§8 Warranty

Statutory warranty rights apply.

§9 Compatibility and Platform Changes

(1) The product is designed to function with compatible consoles and software environments at the time of purchase.

(2) We do not guarantee permanent compatibility with third-party hardware, firmware, operating systems, updates, or platform services.

(3) Updates, restrictions, technical measures, or policy changes introduced by console manufacturers or publishers may limit functionality.

Such changes do not constitute a defect of the product.

§10 No Affiliation Disclaimer

AutoShinyCounter is an independent fan-made product.

It is not affiliated with, endorsed by, sponsored by, or approved by Nintendo or any other game publisher or console manufacturer.

All trademarks (including Nintendo, Nintendo Switch, Pokémon) are the property of their respective owners.

References are used solely to describe compatibility.

§11 Hardware-Level Operation

The product operates externally and does not:

  • Access or modify game software
  • Interfere with console firmware
  • Reverse engineer protected systems

It functions as an external counting and input-support tool comparable to programmable peripherals.

§12 User Responsibility

Users are solely responsible for ensuring compliance with:

  • Terms of Service
  • End-User License Agreements
  • Platform policies

of the respective game publishers or console providers.

We do not guarantee that third-party tools are permitted under all publisher policies.

§13 Intended Use

The product is designed for legitimate purposes such as:

  • Tracking repetitive resets
  • Accessibility assistance
  • Reducing manual counting
  • Stream integration and statistics

It is not marketed as a cheating device and we do not encourage unfair gameplay.

§14 Limitation of Liability

We are not liable for:

  • Platform bans
  • Account restrictions
  • Game publisher policy enforcement
  • Compatibility loss due to updates

To the extent permitted by law, liability is limited to intent and gross negligence.

§15 Severability Clause

If any provision of these Terms is invalid, the remaining provisions remain unaffected.
